Flood risk rules halt Daniel’s dream home rebuild

A MAN is being forced to live in a caravan because planning rules are stopping him from rebuilding his home.

Daniel Baker, 27, bought a three-bed bungalow for £137,000, in High Street, Canvey, in October, 2006, which he planned to renovate into his dream home.

But he had to demolish the whole building because it turned out the walls and ceilings contained asbestos. The wooden frame was also riddled with woodworm.

Mr Baker has spent the past year busily designing plans for a four-bed bungalow to build in its place.

But his planning application was rejected by Castle Point Council last month, so he is having to live in a caravan on the site.

The main grounds for refusal were controversial planning rules preventing new homes being built on flood plains which are causing many applications on Canvey to be refused.

Mr Baker said: "This is ruining my life. The planning rules are so stupid.

"I've been saving up to buy this house, ever since I started a paper round when I was 12. Everything I've got is invested in this place.

"It's not like I want to build a completely new place, all I want is to replace like with like."

Neighbour James Marsh, 77, is leading a campaign backed by 11 other residents who live nearby to change the council's mind.

He said: "We're all stuck with an overgrown pile of rubble next door.

"There's no way any one of us will ever sell our homes, unless it's rebuilt.It's crazy because there's no flooding risk. We're writing to our councillors to see if common sense can prevail."

The Environment Agency is waiting for the results of a study, due out this summer, before it is expected to make changes to planning regulations affecting building on flood plains.

Planning applications to build on flood plains are being refused across the country, while councils wait to see what changes will be made.

Lea Fountain, council spokeswoman, said Mr Baker's application was turned down on several grounds, not just flooding concerns. These included potential loss of neighbours' privacy and traffic congestion from vehicles pulling out of the bungalow's drive into the High Street.

Just build it without permission and plead the human rights act.
On second thoughts you had better not as the council will come down on you very hard, as you a not a liberty taking irish house dweller.
This just goes to show what a shambles of a country we have become.

Build your home on stilts!

On the banks of the Danube - a natural flood plain - the homes are on stilts so when it floods in spring the people are high and dry and can sit out a few days flood!

He already lives in a caravan. If he gets a few more to move on to his land perhaps he could then obtain a £12,000 grant from Essex County Council to build a building without planning permission. Oh sorry, I forgot that will not work; his land is not green belt.

You also forgot a few other things Ian...

He is a law abiding citizen who is trying to do things above board.

He hasn't got armies of do gooding friends tucked in his back pocket.

He doesn't keep slaves.

He isn't a menace to his neighbours.

His actions haven't been in total disregard to everyone else.

He is most likely paying council tax and utility bills.

His nationality is most likely English which will automatically put him at the bottom of the pile.

I'm sure others could think of some more reasons.

Ian, they didn't apply for this grant. They got given it on a plate by a handful of vacuous and self justifying 1diots who saw fit to be free and easy with OUR money.

I've had an email conversation with ONE of those responsible (the others didn't reply to my emails surprise to surprise) and if Lord Avebury is anything to go by, then it's perfectly in order for the likes of him and his do gooding mates to please themselves how they liberally spend taxpayers' money.

And as none of them, except Father John Glynn, live in this area, it's even more OK - because it's not money coming out of THEIR local authority.

Smug. sanctimonious twerps - and that's the mild version.

I m praying for the day they get a traveller site right opposite their homes.

Still, these days you never know what might land up on their doorsteps as such folk make it a personal mission to invite all and sundry into this country with no regard whatsoever for the consequences.

Hang on. If you can't build on flood plains, how can the government go ahead with the Thames Gateway project. It's all on a flood plain.

Once again individuals find getting anything done difficult while supermarkets can build stores at will. Perhaps Mr Baker should offer the council a bribe...sorry, I mean, 'offsite incentive package' just like Tescos did near me.

Absolutely ridiculous. Castle Point Council allow time and time again more and more flats to be built in the area - the majority of which have not been sold, yet they will not allow this poor man to build a house.

As a local resident I live very close to the site, i pass by at least twice a day and knowing the state of the original house. I can not see any reason why the council have refused permission for a new build. Daniel Baker has obviously clearly thought the building through and surely we should encourage people who want to make the area appear more asthetically pleasing. There has been a lot of bad press about the run down apperance of Canvey recently, and the local residents just want to live in the area of their choice without their properties being devalued by this eyesore. The reasons the council have given to Daniel are laughable. Castle Point should be investing in the upholding citizens of the island like Daniel who want to enhance the area instead of condemning them.

hhmm i smell a rat
2 years ago he purchased this 3 bed bungalow it would have been looked at by a surveyor,,
then just 2 years later he discovers all this knocks it down and wants to build a four bed ???

yeah i live in a 3 bed semi detached house on the island
im sure when i was in bed last night i heard woodworms having a party in my loft,, think i might knock my house down and build a nice new six bed
