Rayleigh woman who had stomach removed ordered back to work

A WOMAN who had most of her stomach removed to cure a crippling condition claims she was ordered back to work just three weeks after her operation.

Michelle Stainer had suffered excruciating pain for two years because of ulcers when surgeons at the Royal London Hospital in Whitechapel decided her only option was to remove most of her stomach.

They operated on October 3, leaving only a small pouch of stomach after removing areas that had been badly scarred by the ulcers.

She said she was discharged on October 8 with the advice to eat just tiny amounts and that she would need between three to six months to fully recover form the operation. But she was left stunned when only three weeks later a doctor at the Churchview Surgery in Rayleigh allegedly refused to give her a certificate excusing her from work for a further four weeks.

The 37-year-old secretary of Derwent Avenue, Rayleigh said: “I was still getting stomach cramps after eating anything as well as sickness and tiredness. The surgeon said it would to take at least another four to six weeks for that to settle down and an average of three to six months to fully recover.

“All I wanted was another month because for the three months before the operation I had to claim employment support allowance because I was so ill. I really want to get back to work but he refused to give me just a bit more time.

“Dr Babar, who I had never seen before, told me he worked for the Department for Work and Pensions tribunal board and that he would be issuing me with a certificate that I should be back at work. I took the certificate and then went out into the waiting room to my mother who had been waiting for me as I have not been able to get about on my own. She couldn’t believe it.”

Mrs Stainer, who is separated from her husband and who was forced to return home to live with her parents during her illness, said she was told Dr Babar based his decision on discharge reports he had received from the Royal London.

She added: “I called my surgeon’s secretary to ask what was going on and she said the papers hadn’t even been completed out at that point. “On Friday they faxed the surgery telling my GP that I must have another month off at least to recuperate.

It was sent around 4.15pm and my mother called the surgery at 5.30pm to ask when my certificate would be ready for collection, only to be told that I would have to wait until Monday (Today, 29th Oct) but I still don’t have a certificate.”

Susan Morris-Newnham, spokeswoman for the South Essex Primary Care Trust, said: “We have spoken to the practice and although they are unable to make comment on individual patient cases, due to patient confidentiality and data protection, they can confirm they received a complaint from the patient and that this was fully investigated and responded to.”

Ms Stainer said she has not revceived anything from the Trust.

The Echo reported how Dr Anne Dyson, a GP from South Woodham Ferrers, had written to the British Medical Journal complaining that the system for claiming sickness benefits has been deliberately complicated in order to reduce the number of claims.

What is even more annoying is that the very people representing these continual cuts have the cheek to continually sing from the rooftop on what they would do knowing they either have not got a chance of doing or if they do the party will use the whip to quieter them or deselect them at future elections !!

Conflict of interest if this GP is trying to save the govt money yet giving sick notes for people. Seems one pays him more than the other. At least we all care enough.
Time for society to claim big time at these injustices. Time for those that do abuse the system (not this lady) to be accused of theft - to claim sick benefit and not be sick is just that and others are tarred with the same brush.

If the good people further up the ladder would just pay a little of their taxes, perhaps I would agree with you. But here we have an obviously sick woman being ordered back to work by the DSS because it is only the workers and the retired pensioners who are actually paying tax. Try stomping out the VAT fiddles, the expenses fiddles, the "I don't live in Britain" fiddles and that will go a long way toward supporting the sick. Then add a real penalty for fiddlers, albeit tax or injury or whatever, then we may see incentive return to Britain. This giving everything to the Elite is plain nuts!

Btw it says Doctor Babar worked for the Department for Work and Pensions tribunal board so he is far from independent, he is a Government lackey responsible for implementing the Govts new welfare/incapacity regime which is being criticised for unfair decisions such as denying benefits to people who are clearly unwell but who don't meet Camerons new narrow criteria.

I know someone else caught up in this mess who is suffering from a genetic disease which is fusing his bones together. He worked for 45 years but he can barely walk now, can't drive and struggles to do almost everything but he has been judged as fit to work as he can just about manage to walk 50 yards albeit with great difficulty but in reality he is an old man who is truly disabled and never going to get better. Other cases have been reported in the press where the Govt have denied benefits to people with serious cancers and people so ill they have died whilst waiting for their appeal to be heard.

We all agree that fat teenagers and heroin addicts should not be classified as unable to work and receive extra benefits but Camerons crackdown is so severe it is turning down genuine cases such as the woman above and my friend, which is shameful but typical of the nasty party. Like I said before I hope you never find yourself in this position.

While I understand what you are staying there is a second side to the coin. These corporations are employing many thousands, who are paying tax and NI. If the Government came down on them like a ton of bricks, how many would simply shut up shop, making their UK employees unemployed and forcing them onto benefits?

If the Government came down on them like a ton of bricks, how many would simply shut up shop, making their UK employees unemployed and forcing them onto benefits?
Why bother collecting corporation tax at all then? Your argument is spurious and highly offensive to all the businesses who do pay UK tax. Tax avoidance or evasion is immoral and unfair by any standards. Do you live on the same planet as everyone else?

You miss understand me. I do agree that everyone should pay their fair share of tax. Unfortunately, non payment of tax by big corporations is not new, it has been going on for years, not only under this Government but former Governments as well. What I was trying to point out is that if these corporations chose to shutdown unemployment and benefit costs would increase and tax income would go down. I have no doubt that the Government has worked the numbers and knows exactly what the financial affect would be.

Then you have far more faith in the government than I do. Do you really think that people like Phillip Green would close all his businesses down if he was forced to pay tax in the UK rather than siphoning all the profits off to his wife in Luxembourg? Then you are extremely naive sir. The trouble is that tax avoidance has become a hobby for everyone from BBC presenters to supply teachers and this is costing the country dearly. I even know local people who are doing this, an ex friend of mine made a killing in property development in the 80s but he set his 'rental empire' up in such a way that all the profits were sent abroad and he boasts that he has never paid a penny in UK income tax. That is quite simply not right whether it is little local businesses or huge multi national corporations.

Twinings and Gillette are two such firms that took their production abroad and simply sacked their workforce. This caused massive unemployment in the towns concerned. With the use of sweat shops their manufacturing costs plummeted. So did the consumer benefit? Not one iota! prices actually increased (check out Gillette and Wilkinson shaving gear.)

However, the answer to the perceived blackmail by these trough huggers is simple. List their names, list their crimes and, as a nation, boycott their products. The "I'm Backing Britain" campaign did a lot of this in the 1960's. But please remember before you say it was not the Tory government to blame, it was that government that lifted the restrictions on how much currency you could take abroad and that, combined with the well implanted loopholes in the tax system, enabled those people to cut and run when they proved, especially in our car industry, that they only know how to rake in their money, not how to earn it! And now they are attacking the sick simply because they can. Who on here, that is critical of the lady concerned, has actually suffering her problems and is still doing a full day's work? I would lay money that not one of you is. If that is the case, then you are proving yourself trollers and, as such should be totally ashamed of yourself!
