A WOMAN sat in protest in her car for more than four hours after bailiffs clamped her and threatened to tow her away.

Charity volunteer Susan Hatton, 61, of Leigh, said she would rather be impounded than pay the £695 fee which had spiralled from a £35 parking fine from more than a year ago.

The baliffs, working for Southend Council, tried to seize the car yesterday.

However, after the Echo intervened the clamp was later removed and the council has now promised to review the case.

Mrs Hatton said: “I would have gone to the pound with it. They still haven’t taken me to court. I want my day in court.”

The volunteer came out of the St Mary’s Horse Refuge shop in Sutton Road, Southend, with her arms full of items for auction to find bailiffs had clamped her car at about 11.15am.

After sitting in the car for more than four hours as bailiffs waited for a recovery vehicle to arrive from Kent, Mrs Hatton said the clamp mysteriously disappeared as she popped to a cafe to visit the toilet.

Yet the council confirmed the bailiff had not removed the clamp and its removal was being treated as unauthorised.

The Echo told on Monday how Mrs Hatton was fined £35 for dropping her sick 84-year-old father, Ken, off in Eastwood Road North, Leigh, in December 2011.

The fine rose to £167 after Mrs Hatton refused to pay it because she had only stopped for eight seconds, but yesterday the bailiffs informed her it now stands at £695.

She said: “It’s annoying. I keep thinking eight seconds and now I owe them £700!”

Her fellow volunteers at the animal welfare charity supported her.

Sam Hurst, 33, of Southend, said: “It’s a bit much isn’t it. It’s more the fact that how they knew she was here. They have been following her.”

Lin Michaels, 61, of Southend, said: “It’s unjust.

“In 61 years I’ve never been in trouble with the law but I think this is so bad I would jump on the truck and bend its windscreen wipers to stop her car being taken away.”

Peter Geraghty, Southend council’s acting head of planning and transport, said: “We appreciate the anxiety situations like this can cause.

“We will be reviewing the relevant CCTV footage and the circumstances under which this penalty charge notice was issued.”

OK, the law is the law but 8 seconds? Clearly a case of overzelous jobsworths.
Involvement of baliffs should only ever be done if it is to recover fines imposed by the court. This lady has not had her day in court because these parking cases are often mass cleared through a clearing court without the knowledge of the vehicle owners. This practice should stop.

I am now begining to understand why we had the story the other day about the £167 that Mrs Hatton owed for a parking fine. The original fine was just £35 you should have accepted that you were wrong and paid the laws are quite clear on these matters. If you had paid you would now not have bailiffs clamping your car after a much larger amount as these amounts seem to grow very quickly. I suspect that Mrs Hatton knew this larger amount existed and was trying to get support on board via the paper to avoid payment. Sorry Mrs Hatton you dug the hole now get out of it.

Afraid that is correct much as many people sympathise. If it was in a bus stop with solid yellow lines you cannot stop at all. Actually on a double yellow you can stop and let passengers out. As her husband is a taxi driver I thought he would have known that.

She claimed she was only stopped for 8 seconds when dropping off her SICK 84 YEAR OLD father. Don't mean to be rude but I strongly doubt that she was only stopped for 8 seconds. Even dropping off a a young healthy person would probably take longer! Should have paid the £35 at the time. As for wanting her time in court, it would probably end up costing a lot more than she owes now once costs are added!

you would be surprised how many are operating with invalid or expired licenses.

a bailiff is required by law to provide you with license number and court order to levy goods.

ensure you get a date in court.

any fine leading to the removal of goods must go before a magistrate. otherwise it is not a fine (it a penalty notice) and goods cannot be removed without a court fine.

lock it away.

if a bailiff comes to your house 'don't let them in' unless it is for non payment of council tax or they have a warrant from the courts (ask to see it) then they can only make 'peaceful entry' they cannot levy goods that they cannot see. keep your car in a garage or park up a fare distance away from your house.

do not let them in. If they attempt to force an entry 'call the police'

Also, she must have expected this at some point had multiple letters warning of fines rising and risks of non payment. All of these would have been accompanied with details of how to appeal the PCN. If appealing with the council fails then there is the independent tribunal process (which is free and you don't even have to attend!) if she didn't use this appeal process then she's only got herself to blame.

Be a Magistrates court at the most, thats if you even went....
Shows you how thick you are, If you appeal a driving offence or parking offence you cannot have a jury. You have on Judge and his verdict is the final verdict with no appeal. You have to be heard in magistrates first and then ask for Crown. Learn listen and dont make comments of things you dont understand

Yes there are 3 kinds of Burglary.

Yes theres different kinds of burglary

(1) If someone forces open a door in a shop and steals a pint of milk and a bag of crisps thats burglary. Not theft its burglary

(2) If someone enters a locked dwelling or building and steals the till thats Burglary

(3) If you are asleep and a person breaks into your home and steals your items thats also burglary.

Not the point. If you haven't done it then don't plead guilty or pay the fine, of course you appeal. Your useless solicitor was rubbish if you had to go that far when there was obviously video of you moving as you said, why not produce this much earlier. The thing here, is this woman has accepted she DID stop on the wide yellow line. See the difference?. By the way, why have the Echo made the effort to describe her as a charity volunteer. Would it make a difference if she were a shop assistant, baker, unemployed? Looking for sympathy by any chance???

everyone would have more sympathy for her if she had gone over her car park ticket by 5 minutes or broken down etc ....BUT she used a bus stop to stop and she was not driving a bus, its on film, banged to rights( 7seconds or 2 minutes all the same) and it was only £35, a cheap lesson learned..imo....but ohh no she felt hard done by and probably ignored the initial fine thinking nahh what can they do..take me to court...? maybe a judge would side with her (she thought)....but it don't go to court it gets passed on to debt agencies and grows, now i'll wager IF she had the option to pay the £35 Tommorrow and forget all this she would pay the £35....exactly what should have happened in the first place., an expensive lesson learned and not all in a monetary way..!!

I would not pay a fine if I did not commit the crime. If Susan believes she did not commit an offence then good for he standing up for herself.

What I don't get is that this womans' car was clamped,and she sat in it - fair enough, nothing can be done while she is in it. But, she exited the car and the clamp disappeared. That is a little fishy to me. But at least with the above photo we now have the clampers name and phone number, so perhaps the clampers SIA and licence was questionable, and they actually had no court order to impound the vehicle.

COMPLETELY missing the point. The woman admits she WAS parked on the wide yellow line. She's just upset that she got caught. A bit like taking a pen from work, it's only 'a litle bit theft' but it IS theft., or your headlight not working on your car, 'it's only not working a little bit' But it's NOT working All laws are based on the same principal, either you have done enough to commit the offence or you haven't. Simples! If you get caught, deal with it, don't start bleating about yes I did it but only a little bit, I know let's have my 15 minutes of fame in the local paper, oh and let's say I'm a charity volenteer to get some sympathy as well.

Dont have a clue what your on about. Courts are not open on a Sunday unless by approval. My days of sitting on the bench have been over for 14 months.

Best you check your details about Sunday opening unless you meant Waitrose in the high street.

I will explain again cos maybe i used joined up words and not capital letters.

I got through the post a £100 fine and a letter stating I had to send my license in to get 3 penalty points.

I sent all the rubbish back to where it came from with a letter saying incorrect I did not stop and was never stationary. OK ! are you still with me ?

I attended Newham Magistrates court and nice clear photos we given to me and to the magistrate. I said loudly ..Yes Sir that is my range rover, yes Sir that was me driving and NO SIR i never was staionary for even half a second. The idiot magistrate said extra £50 fine and £75 costs. Are you still with me ??

We appealed to crown court and asked for the moving cctv and moving traffic camera evidance for the crown court.

Try and keep up dear !

In Snaresbrook crown the moving photos were shown on a tv type of screen twice and Judge looked at the enforcement officer and asked loudly to the traffic enforcement office explain what you saw on screen and the enforcement officer stated to the Judge who sat alone on the bench, no jury, after looking twice at the moving film that at NO time this defendants vouge was stationary, he said but it was only just moving but NOT at anytime staionary as the still photos showed at magistrates court.

The Judge found in favour of myself and apologised for the incorrect traffic prosecution, I got £90 awarded for unlawful prosecution. As the Judge stated, you have to be stationary to be convicted and as the film showed I was just barely moving and never stopped at anytime.

Hope now Ive explained why how and what. Im sure you can grasp this ! I was NOT GUILTY ..

I also think its wrong how some people support the Nazi's but people have their own thoughts and we all must accept peoples thoughts as long as they are not promiting racism. Ive seen nothing on this site to show me racism cos i would be the first to speak up.

You gotta accept that not all people think like others. Nazi's and the Gestapo were bullys in uniform and i can understand why people think these road enforcement officers and spy car drivers are i suppose is an extreme way of describing them.

We might think its extreme but they dont and in this life we cant get rude and abusive to people for their veiws.

Yes the woman should have paid the fine, she was wrong but she believed she was right. Thats her choice to feel she was right so why do 70% of people give her abuse.

Everytime I say my bit I get mongrels telling me Im wrong. Its all a matter of opinions. Surley if someone dont agree then thats their thoughts and we should accept another persons opinion. No one is right or wrong cos its opinions not gospel.

No way did she stop for 8 seconds (last week it was 7 secs!). Has this really been going on since December 2011?
Realistically there is no way she stopped her car (illegally), dropped off the 84 yo father and drive off in that time.
Just grow up women, stop wasting tax payers money with stupid appeals and pay the fine.
They have even reduced it back to £70 and she is being a stubborn fool and not paying that either.

would be great if these cars where infact Bright Orange/Yellow etc....that way they would stand out more instead of the blending in White and black, after all they are a deterrent and the brighter colours will deter more people from parking wrong as they will spot the camera car easier....but will they change colour thus reducing the income..? will they ****.

I see from other reports that she has been clamped again, despite the council admitting they were going to investigate, on the second occasion the police were called. The worrying thing is that these 'bailiffs'/'clampers
's are clearly following her around !

The BBC did a great program on councils and their abuse of parking/driving fines and a good proportion of the programe was all about Southend's spy car.

This is all the fault of the lady in question.
You get a ticket, you either pay it or send in your evidence and other information to southend council.
They review it and say yes or no.
If its a no you get details on how to appeal if this is unsuccesful then you pay and make it clear you do not admit guilt but are paying as you have been found guilty and fined. Then you appeal to the tribunal.
Why let it get to bailiffs they dont have an appeals procudure and you cant reason with them as they are acting under the law.
Its strange the lady sat with her car for four hours and then went to the cafe rather than the charity shop she works in to use the loo only to find the clamp disapeared although local taxi drivers have a theory about this.
The bailiffs are using ANPR tech to find cars and i would believe will in the end do a snatch and grab job with a full lift truck that can get a car over walls or in blocked spaces. She will lend up loosing the car completely if she isnt careful and still owing the bailiffs some fees. Her day in court migh come but it wont be about the parking fine but to enable a ccj against her so bailiffs can recover their cost because the car wont be enough soon to cover it. (cars sold by bailiffs generally only make 40% of their value)

I hope the council take her to court - where she will lose and look very silly.

Pay the now reduced amount and carry on.

Stopping on a bus stop is a big no-no - everyone knows that and if she didn't, should she be driving?

the thing that amazes me is her statement that she was only there for 8 seconds, it takes my 16yr old daughter longer than that to get out of a car, let alone an 84yr old infirm man. Even Blue Badge holders are not permitted to stop/park in a BUS stop. She claims the council are being selfish. "pot kettle and black" spring to mind. She stopped in a BUS stop and being as she is not a bus she had no business being there. If a bus had come along and couldnt get in, she would have forced the passengers on that bus to get off in the road, not funny when you have kids. All she had to do was stop a few metres further down the road. Pay up and stop whinging. Selfish Person that you are.

So a Confirmed Report in todays Echo says the council has reduced the amount to £70....a life line i would say, and she is still not paying up and wants to go to court..how can she think she is right when *98% of people think she is wrong.

Parking matters are civil matter and would never go to Crown Court, so your so called 'not guilty' plea it the same rubbish you continue to spout off on this site.

People might not like getting a parking ticket, but however deperate they are they are never going to follow your 'call to arms' against the system as you spout of rubbish every time.

just read mondays echo which updates the story. This woman is an idiot!!! Here own husband drives taxis and would be livid if someone parked in a taxi rank preventing him from pulling in. Same highway code section covers taxi ranks as it does bus stops. She is either a complete lier or the most unlucky person in the history of the spy car to be caught dropping off her poor old father which she claims took only 7 seconds. So from what she claims the spy car photographed her pulling up till pull away she should be looked at for abuse if she shoved the poor old sod out in 7 seconds and pulled away. Or perhaps she tells small white lies and hopes to get away with it. Like never receiving letters about the fine and appeals procedure. No sympaphy and its about time the council send whyte and co in to remove her car.

Reading back through Carol's comments made me laugh - surely a magistrate would know the difference between civil and criminal? Oh but she hasn't sat on the bench in 14 months but was in during August, but she wasn't actually there... and we've not head from her since...

Anyway I'm sorry but have to agree - firstly, 7 seconds for an elderly gentleman who can't walk to a bus stop to get out of a car seems impossible, and if she'd just accepted the fine, and the ruling of the council, none of this would be making news.

I guess it's just the 'I'm hard done by, I'll try and get out of it' sob story approach. Too many people run to the papers these days...
