Council wins injunction against 1000 car cruise

SOUTHEND Council has won an injunction to prevent a 1000 car cruise.
The civil order will help them put a stop for the rally which is planned for Saturday.

I was really looking forward to this cruise and to meet up with a few friends. I live in Southend and DID love it. But this has really disheartened me and made me feel quite sad and rejected from the town I live in. The injunction says "Car Cruise means a congregation of the drivers and/ or passengers of 2 or more motor vehicles (including motor cycles and quad bikes) at any time on the public highway or at any place to which the public have access within the Borough of Southend." Does this mean 2 of my friends in their cars and myself in my car can't drive to mcdonalds and park up together?
I know some people park stupidly and litter, but if this happens it should be dealt with accordingly. This happens everyday, people park on double yellow lines (including the police on the double yellows in the highstreet) and people litter everyday but by highlighting it at a car cruise and plastering it all over facebook/the echo it is just shining a bad light on the car scene and making us all look bad. There are no car enthusiasts opinions being voiced in the echo which I dont think is fair. I think by enforcing this injunction it will just make the situation and peoples attitude to SBC and Southend as a town worse.

So as long as they don't turn up in a convoy, dont speed , make excessive noise , Race, litter or perform stunts then they are not in breach of the injunction,
So, turn up singly and act civilly and within the law and there will be no problem and they can park up and chat to their mates without breaching the injunction.
All its done is to reinforce the existing laws and is large designed to prevent the antisocial behaviour.
No one is being stopped from coming to Southend, just the manner in which they (mis)behave when they get here

Which means you and your friends can quite happily turn up on the seafront for a chat , same as any time during the year as long as you don't perform any of the activities set out in Para 2.
Its nowhere near as draconian as it is being made out to be , it just gives the poers that be a fast track option to act on those who break the current laws regarding public order and the local bylaws regarding littering , noise etc.
If, however, people decide that having to behave themselves is a good enough reason not to attend then thats up to them.

In fact I think they've missed an opportunity. All the seafront traders could have done well from a few thousand extra visitors on a cold winters evening.
A little bit of thought coupled with a media message saying " you're welcome to come, but don't break the law" and a visible Police presence as a deterrent would have worked.

What a pathetic council this is - Clearly there is an opportunity to actually drive some of the public into what is pretty much a ghost town from the months of November - April. Even if there were 1,000 cars arriving, surely enforcing pay and display @ £1.50 -£4.00 a throw, would bring some much needed revenue into the coffers.
I wonder what a freedom of information request would show with regard to local complaints during these 'cruises' and how many people were actually prosecuted for breaking the law? I bet your average night outside any of the clubs or bars in Southend bring more police call outs
Then again that prat Shoebury_Cyclist will no doubt be making full use of the facilities down there

Some of the people do spoil it for the rest of the groups with dangerous driving but i will say that i know for a fact the seafront food/shops/arcades also get a nice boost in profits and would say it wouldnt hurt to put some more bins around.

The injunction only applies to someone on who it has been served by a police officer or Officer of the Council who by their actions is doing the following:-
1. Car Cruise means a congregation of the drivers and/ or passengers of 2 or more motor vehicles (including motor cycles and quad bikes) at any time on the public highway or at any place to which the public have access within the Borough of Southend, the boundaries of which are delineated on the map at Schedule 1 at which any such driver and/or passenger and/or driver and/or passenger of any other vehicle perform any of the activities set out at paragraph 2 below, so as, by such conduct, to cause any of the following:
(i) excessive noise of any kind;
(ii) danger to other road users and pedestrians;
(iii) damage or risk of damage to any property;
(iv) litter;
(v) any nuisance to another person not participating in the Car Cruise
The activities referred to at paragraph 1, above, are:
(i) driving at excessive speed;
(ii) driving in convoy;
(iii) racing other motor vehicles (including motor cycles and quad bikes);
(iv) performing stunts in motor vehicles (including motor cycles and quad bikes);
(v) sounding horns or playing radios;
(vi) dropping litter;
(vii) shouting or swearing at, abusing or threatening or otherwise intimidating another person.
So, in other words, anyone can quite easily come to Southend drive legally and properly, park up and have a chat, admire cars, don't litter, don't play music loud enough to wake the dead, don't behave in an intolerable way to other members of the public and don't cause congestion in the town by driving around in mass convoys and afterwards leave in an proper manner. However, come to town and do anything that causes the police or council to serve the injunction on you and you then continue to act in that manner then you will not find yourself up in front of the magistrate or getting a FPN but up in front of Mrs Justice Gloster in the High Court for contempt of court; if you do then remember to take a toothbrush as contempt often results in a little custodial holiday.....

I will be getting in touch with Southend council and Southend police to arrange talks, and bring back the monthly LEGAL cruise.
Obviously I won't get backing from the Echo so publicity will come through other local papers. But if you support me please post on here or search for my upcoming Facebook group.

Just because it’s a ‘charity’ event doesn’t make any difference. They drive along my road to my annoyance.
However, I don’t want to stop them in the same way as I don’t want SBC to stop the ‘cruisers’ as I can put up with a little annoyance in order for others to enjoy themselves occasionally
