Shoplifter with more than 50 offences faces jail again

A SHOPLIFTER with more than 50 offences to his name is facing jail again - after homelessness drove him to desperation.

Phillip Day, 28, felt he was being “set up to fail” after he was released from prison with nowhere to go.

He began to offend again and was soon in Chelmsford Prison appearing at court via videolink.

Day, of Ceylon Road, Westcliff, had admitted four counts of theft which happened in December 2012 and January this year, and to breach of a suspended sentence.

Judge Owen Davies said that he had looked at Day’s background which showed more than 50 offences. He said: “The picture is depressingly clear.”

Maria Dineen, mitigating, said her client had raised his concerns when he was last in court in December.

She said:”Mr Day questioned with the court on that occasion whether, in his words, he wasn’t in fact being set up to fail on that occasion.

“He came out of prison with no home, no money.”

She said friends had put a roof over his head for short periods of time, but then he had begun to offend.

She said: “He had not got any benefits in place, no means of feeding himself, he had swiftly fallen back into his old ways of drugs and alcohol.”

Judge Davies asked for probation officers to look at whether the “Bridge Project” would be a suitable alternative to prison, along with a drug rehabilitation requirement. This project is for prolific offenders and designed to break the cycle of offending and going to prison. Day will be sentenced on March 14.

All the DAy family are well known scum bags. None of them have ever attempted to change their ways. Highly unlikely to ever break that cycle

Are we supposed to feel sorry for this waste of space or something?

He came out of prison with no home, no money. Thats where we are going wrong. Next time when he comes out of prison we should give him a house, and enough money to pay all his bills and buy his drugs, so as he can get on with his life without having to steal. Perhaps we should give him a car and a holiday as well.

No money to feed himself but he found money for drugs and alcohol!!!
If he hadn't gone down this route in the first place he wouldn't have the criminal record which put him in this situation.

I met this guy a few times through work. He always said that he wanted to clean up his act when ever he got out of prison but never did. I'm not saying what he did was right at all but does it also show that there seems to be a problem with probation that there was no help for him when he got out i.e. somewhere supervised to live instead of having to doss on mates sofas which would undoubtedly set him down the wrong road again

This ratboy stole from a poppy box last year, and is a piece of crap always waiting outside CRI chase road to bully other druggies, give him a drugs order with CRI and they will have no other customers ! he is a complete waste of air like many other losers on these drug orders, what is needed in southend is a bad batch of drugs to clean up southend, stop blaming probation, the police or prison, blame the ratboy, send him to iran on a one way flight.

Hey, don't give Shoebury_Cyclist any ideas! That's exactly what he'll be demanding for this 'poor unfortunate homeless soul'...

Perhaps start doing something about the suppliers of the "Harmless drug" (As we are told by the pro-druggies) by deportation if they are not British, and long prison sentences where they have to work to keep themselves if they are British. None of the "Softly softly" rubbish seems to work, so, how about it?

It's interesting to note that this individual is the youngest of three male siblings....

One is dead - died/killed? in Frankland prison.

Another is serving a Life sentence.

The other is hobbling about having suffered a stroke....

.... No happy days!

Why on earth was this scumbag allowed 50 chances? Bang him up after the first offence - after all, this government is tough on crime!!!

Yeah thats right, the one killed in prison was a registered police informer if I remember correctly, they promised him a transfer from a London prison for his own safety but stitched him up & let it be known he was a grass, he wasent very popular when he arrived at Frankland and decided to depart by hanging himself. There was a documentary about that years ago.

& the guy serving life killed a young lad off of Southchurch Road about 10 years back. I assume its the same guy.
