Basildon Council takes man to court over £32 bill


A MAN is preparing for a court fight with Basildon Council following a row about a £32.21 council tax bill.

Father-of-four, Simon Wallis, 34, is fuming after receiving a court summons.

The glazier has been out of work since last September with a back problem and has been claiming benefit to cover his council tax bills.

However, he did a single week’s work in January for which he accepts he owed the council £32.21 in council tax, which he paid by phone yesterday morning.

But he says he never received the bill and the first he knew of it was when a court summons came through his door on Wednesday morning.

He says he happily paid the council tax charge, but refuses to fork out for the £45 council administration fee which comes with the summons.

The council has told him to pay both or appear before Basildon magistrates on March 26 and face the prospect of also having to foot the bill for legal costs.

Mr Wallis said: “As soon as I got the summons I called the council to explain I never received the original council tax bill.

“But they refused to listen and their attitude was: ‘We sent the bill and you didn’t pay it, so now we are taking you to court – tough luck’.”

Mr Wallis of Longwick, Langdon Hills, says before his current break from work to wait for an operation, he has always had a full-time job. He says he has worked since he was a teenager and has always paid his taxes.

He said: “It’s not right the council thinks it can just bully people like me who have worked all their lives and paid into the system. My wife has told me just to drop it and pay them, but I’m not prepared to do that. As far as I am concerned I’ll have my day in court – if they want a fight, then they can have one.”

Phil Turner, the council’s cabinet member for resources, said he could not comment on individual cases, but standard recovery procedures were followed in Mr Wallis’s case.

He said the council sends out a bill and then a reminder, and if an arrangement for payment is not made within seven days, a summons is issued with an administrative charge.

He said: “If every household in the district failed to pay a week of council tax this would create a shortfall of millions of pounds, which would have a negative impact on services the council is able to offer.

“Residents have a duty to establish if they are responsible for paying council tax and to pay on time.”

Just pay it stop being a total nob!!

I am sick to death of having to pay other people's debt and benefits.

Still even if you lose the 'Socialist Republic Brown Party' will look after you especially if you now need to take benefits for the next 20 years.

The OAP's that have worked hard all their lives that own their own properties and are too proud to seek benefits will pay for you mate.

Lucky for you that there is no debt here then.
The Council Tax has been paid as I fully admitted that I owed it, and would have paid it sooner had I have recieved a bill instead of a summons some 7 weeks later.
If you read the story properly you will see that, would you hand over an extra £45 just because the council tell you to? I dont think so. Its their system and I fully support it but if their system has failed should I just roll over to appease idiots like you?
I didnt ask to be out of work and be claiming benefits, I've worked since I was 13 years old, just bad luck that I'm out of work waiting for surgery, but dont panic as soon as its done I'll be back in work and paying my taxes like I have been all my working life.

As a student I am exempt from paying council tax but recently found myself with my house mate who is also a student with a court summons demanding over £1000.

As soon as I received the letter I phoned the council and explained the situation and they put me on a payment plan which extended the payment period by a month.

I then had to use this time to prove my student status by posting copies of the exemption form (which they already had on file stating that my course lasts 3 years)

I also received several letters threatening bailiff action in this short time.

As soon as this was sorted they didn't follow up the summons, its just a scare tactic they use to demand payment instantly!

Yet more smoke and mirrors for Phil Turner and his council tax gestapo. At the end of the year he will trumpet that he has relaimed thousands in unpaid tax. However most of money comes from people who would have paid it anyway. What he means is that they have received thousands in their so called administration fees while the majority of hard core " non payers" will carry on as usual.

* ESSEX HURRICANE APPEAL *

A major hurricane (Hurricane Shazza) and earthquake measuring 5.8 on the Richter scale hit Essex in the early hours of Friday with its epicentre in Basildon. Victims were seen wandering around aimlessly muttering, "Faaackinell".

The hurricane decimated the area causing approximately £30 worth of damage. Several priceless collections of mementos from Majorca and the Costa Del Sol were damaged beyond repair.

Three areas of historic burnt out cars were disturbed. Many locals were woken well before their giros arrived. Essex FM reported that hundreds of residents were confused and bewildered and were still trying to come to terms with the fact that something interesting had happened in Basildon .

One resident - Tracy Sharon Smith, a 15-year-old mother of 5 said, "It was such a shock, my little Chardonnay-Mercedes came running into my bedroom crying. My youngest two, Tyler-Morgan and Victoria-Storm slept through it all. I was still shaking when I was skinning up and watching Trisha the next morning."

Apparently looting, muggings and car crime were unaffected and carried on as normal.


The British Red Cross has so far managed to ship 4,000 crates of Sunny Delight to the area to help the stricken locals. Rescue workers are still searching through the rubble and have found large quantities of personal belongings, including benefit books, jewellery from Elizabeth Duke at Argos and Bone China from Poundland.

_HOW CAN YOU HELP?_


This appeal is to raise money for food and clothing parcels for those unfortunate enough to be caught up in this disaster. Clothing is most sought after - items most needed include:

Fila or Burberry baseball caps
Kappa tracksuit tops (his and hers)
Shell suits (female)
White sport socks
Rockport boots
Any other items usually sold in Primark.


Food parcels may be harder to come by, but are needed all the same.
Required foodstuffs include:

Microwave meals, tins of baked beans, Ice cream, cans of Colt 45 or
Special Brew. 22p buys a biro for filling in the compensation forms.
£2 buys chips, crisps and blue fizzy drinks for a family of 9. £5 buys
B&H and a lighter to calm the nerves of those affected.

Basildon folk have a brilliant sense of humour .... they must have because the biggest joke of all is that they are still letting 92 families get away without paying a penny in council tax ....... guess who I'm talking about?

If the amount has been paid off then it would have better for the council to drop it (whether they are 'technically' right or not).
However, now there's publicity, someone's pride (ego?) will be at stake and they'll probably push this to court to prove a point.
What that point is, only they know!
