NOTICE OF THE MAKING OF ARTICLE 4(1) DIRECTION WITHOUT IMMEDIATE EFFECT RELATING TO OFFICE TO RESIDENTIAL CHANGE OF USE
NOTICE IS HEREBY GIVEN that Harlow Council on 21st January 2020 made a Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 ("the Order") which affects certain land within the area of Harlow Council and which withdraws permitted development rights as specified below in respect of development comprised within Class O of Part 3 to Schedule 2 of the Order.
that Harlow Council on 21st January 2020 made a Direction under Article 4(1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 ("the Order") which affects certain land within the area of Harlow Council and which withdraws permitted development rights as specified below in respect of development comprised within Class O of Part 3 to Schedule 2 of the Order.
The Article 4 Direction applies to land within Harlow Town Centre as shown edged red on the attached plan (marked Appendix A) hereto and being all that land and property known as:
1) Harlow Civic Centre;

2) Essex County Council, Watergarden Offices;

3) Beaufort House;

4) Aylmer House;

5) 2 East Gate;

6) Mitre Buildings;

7) Rothwell House;

8) Westgate House;

9) 2-3 Wych Elm;

10) 13-26 Wych Elm

The Article 4 Direction applies in the affected areas to development that is comprised within Class O of Part 3 to Schedule 2 of the Order (change of use of a building and any land within its curtilage from offices (use class B1(a)) to dwellinghouses (use class C3) but excluding development for which prior approval has been obtained under Class O prior to the date hereof.
On the land to which it applies, the effect of the Article 4 Direction is to require a grant of planning permission to be obtained for development of the type to which it applies. Where planning permission is required, an application should be made to the Council; no fee is payable where an application for planning permission is required solely because of the effect of the Article 4 Direction.
It is intended that the Article 4 Direction will come into force on 12th March 2020.
A copy of the Article 4 Direction and the plan showing the extent of the land affected can be inspected between 9:30am and 4:30pm Monday to Friday at Civic Centre The Water Gardens Harlow Essex CM20 1WG. The Article 4 Direction and maps can also be viewed on-line at

www.harlow.gov.uk


The start date of the period during which representations may be made to the Council regarding the making of the Article 4 Direction is 23rd January 2020.
The period for making representations ends on 28th February 2020. Representations should arrive at the Council no later than 17:00pm.
Representations should be posted or delivered to Julie Houston at Harlow District Council, Civic Centre, The Water Gardens, Harlow, Essex, CM20 1WG or sent by email to

julie.houston@harlow.gov.uk

quoting reference A4O-TC-20.
The Council will take into account any representations that are received by 17:00pm on 28th February 2020 in deciding whether to confirm the making of the Article.
