A CONVICTED killer has escaped an extended sentence for armed robbery despite a report concluding he was considered a “high risk” of carrying out further “serious violence”.
James Gubb, who killed Tony Mahoney in 2000, has been recalled to prison after being convicted of two counts of robbery.
After a dangerousness assessment was carried out, the report writer stated: “There is a high risk further serious violence could occur should he seek to improve his financial situation by criminal means.”
But Judge Ian Graham did not extended the sentence. He said: “I think it would disadvantage you with parole.
"You will not be released until you satisfy the parole board that you are no longer dangerous and that may be a difficult task.”
Tony’s mother, Michelle Harrison, described the sentence as “a joke” and promised to campaign for life sentences to mean a full life term.
