A FARMING company has been ordered to pay more than £3,600 in compensation for deducting cash from an employee’s wages.

Essex Farms Services Ltd, Based in Billericay, was ordered to pay out the cash after deducting money from an employee whilst he worked for the firm.

The employee, known as “Mr R Kaye”, brought a claim to HM Courts and Tribunal Service addressing several issues towards the company.

The firm is based near Outwood Common Road and provides agricultural contracting services to the whole of Essex.

Following a hearing at the East London Hearing Centre, Employment Judge Steven Knight ruled on in favour of Mr Kaye on four issues.

Judge Knight ruled that Essex Farms Services Ltd had made “unauthorised deductions” from Mr Kaye’s wages.

The judge also ruled that the firm had failed to provide a written statement of the particulars of employment, and that Mr Kaye had not been provided with any payslips during his time at the firm.

The judge concluded that the firm was in breach of contract.

In his ruling, Judge Knight ordered Essex Farms Services Ltd to pay Mr Kaye compensation of £3,614.04.

This included £1,094.04 for unauthorised deductions from wages excluding holiday pay, and £270 for the unauthorised deductions from holiday pay.

For failing to provide a written statement of the particulars of employment, the firm must pay £1,800, and an additional £450 for breach of contract.

On top of the compensation, Judge Knight ordered the firm to pay Mr Kaye’s costs of £720.

A spokesman for the firm said: “There was a dispute which Mr Kaye brought forward as he was not happy with what we were offering despite signing an employment contract.

“The dispute has now been resolved.

“We now have engaged with a HR [Human Resources] company to carry out HR related matters.

“Mr Kaye was in receipt of pay slips not the digital versions which he required.

“He could of asked for them at any time.”
