ARCHIE Battersbee's mum has spoken of her relief after winning the right to appeal a court's ruling his life-support should be turned off. 

Hollie Dance says the fight to save her son will continue after she and Archie's dad, Paul Battersbee, were given permission to take their battle to the Court of Appeal.

It comes after the High Court ruled last week that Archie was "dead" and agreed with doctors that he should be taken off life-support.

The 12-year-old was found unconcious at his home in Southend by Ms Dance and has been in a coma ever since.

In a follow-up High Court hearing yesterday, Edward Devereux QC outlined a number of “grounds of appeal” on behalf of the family and claimed the judgement had been made on a "balance of probabilities".

He argued that Mrs Justice Arbuthnot had failed to take into account Archie’s religious views, and those of his family.

The judge approved the appeal, with the hearing set to take place later this week.

Speaking after yesterday's court appearance, a delighted Ms Dance said: “I am so happy the judge has listened to us and has decided to grant the appeal, we are thankful.

“The hospital again wanted it sped up for Wednesday, however the judge has given us until Friday.

“I am just so happy and very emotional right now.

"The decision is such an emotional relief, I feel the decision should be with the parent as no one knows our child like we do. 

"We should have the choice and as parents definitely be allowed to choose if our child is allowed the time to recover or not recover, no one else.

“We won’t stop fighting for Archie."

The announcement of the family winning their right to appeal, comes just a day after hundreds of people gathered in Southend to show support for Archie in seafront vigil.

Purple balloons were released into the sky in support of the 12-year-old, with water fountains in Southend lite up purple.

Ms Dance, who was unable to attend the vigil in person, said it meant so much to the family to see the support from her home city.

She said: “It made me cry when they Facetimed me and showed me that so many people took their time out on their own Father’s Day to be there to support Archie.

“It has melted the hearts of my whole family.

“It means so much.”

Archie was found unconcious at his home in Southend by Ms Dance on April 7 and has been in a coma ever since.
